Official US Bid Committee "Stick & Win - Write & Win" Contest Rules
NO PURCHASE NECESSARY TO ENTER OR WIN
The object of the "Stick and Win - Write & Win" promotion is to submit an original photo to goUSAbid.com showcasing the "The Game is in US" tagline (the "Submission"). USA Bid Committee staff members will judge all eligible entries received based on criteria set forth in the Judging section below. All photos must be submitted in digital format and cannot exceed 250 Megabytes.
Eligibility
USA Bid Committee Stick and Win - Write & Win ("Contest") is open to legal residents of the United States (except Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions and excluding where otherwise prohibited by law, rule or regulation) who are of legal age of majority in their jurisdiction of residence (and at least 18) at the time of entry. Void in Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions, where prohibited by law. Limit one (1) entry per person/email address/household. Employees, officers and directors (including immediate family members (spouse, child, sibling, parent and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of The USA Bid Committee, US Soccer and Blue State Digital, (collectively, the "USA Bid Committee Entities"), and each of their respective parents, subsidiaries, advertising and promotion agencies are not eligible to participate.
Contest Period
The Contest runs from September 12, 2009 at 5pm Eastern Time (ET) and ends on October 31, 2009 at 6pm Eastern Time (ET) (the "Contest Period").
How to Enter
To enter, participants ("Participants") must log on to http://www.gousabid.com/page/s/stickandwin and register by filling out the Contest entry page:

Submission
By submitting the requested information, you will be automatically entered in the Contest. Participants to the Contest will be given the option to receive commercial e-mails from gousabid.com, however, eligibility to participate in the Contest is not dependent upon Participant's consent to receive such e-mails. All information submitted by Participants is subject to the gousabid.com Privacy Policy, accessible at: http://www.gousabid.com/pages/privacy-policy. Participants must complete all non-optional data requested on the online entry form. Incomplete entries are void.
Online entry only. No other method of entry will be accepted. Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to create and/or submit any Submission. Submissions that do not comply with the Submission Requirements or otherwise with these Official Rules will be void, eliminated and not eligible for consideration.
Judging
A panel of USA Bid Committee judges will judge all eligible entries received. Eligible entries will be judged on the following basis:
Originality - 40%
Placement - 40%
Relevancy to "The Game is in the US" - 20%
On or about November 8, 2009 the Participants who submitted the entries with the three highest scores based on this criteria, as determined by the judges in their sole discretion, will be the prize winner ("Winner"), subject to verification of eligibility and compliance with the terms of these Official Rules. In the event of a tie, an additional, tie-breaking judging will determine the Winners from among such tied entries using the judging criteria for Originality. The USA Bid Committee reserves the right to not award the prize if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries.
Publication and Assignment of Rights to Submissions
By entering the Contest, each Participant agrees that his or her submission is an original work of authorship and he or she owns all right, title and interest in the entry as of the date of submission. Entries cannot defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights. If the entry contains any material or elements that are not owned by the Participant and/or which are subject to the rights of third parties, the Participant is responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by USA Bid Committee , the other USA Bid Committee Entities in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the entry.
If any identifiable person appearing in the entry is under the age of majority in his/her state of residence, the parent or legal guardian is required to provide permission. USA Bid Committee reserves the right to require proof of these permissions in a form acceptable to USA Bid Committee from any Participant at any time. USA Bid Committee reserves the right to disqualify any entry it deems to be offensive, inappropriate, not in keeping with USA Bid Committee 's image or that is otherwise not in compliance with these Official Rules, in its sole discretion.
By entering the Contest, Participants agree to assign all right, title, and interest, including copyright rights, in the entry to USA Bid Committee and grant permission for USA Bid Committee , the other USA Bid Committee Entities and their respective designees to publish or publicize all or part of their entry, including but not limited to Participant's name, likeness and photo/photo caption, in whole or in part, for advertising, promotional and trade or other purposes in conjunction with this and similar promotions in any and all media now known or hereafter developed, worldwide in perpetuity, without notice or permission and without further compensation, except where prohibited by law.
Grand Prize
Each Winner will receive a United States Soccer National Team Jersey or an official soccer ball (the "Prizes") (Estimated Retail Value of each Prize is $85.00 United States Dollars). Each Winner is fully responsible for any and all applicable federal, state, provincial and local taxes (including all income and withholding taxes). All costs and expenses associated with prize acceptance and use not specified herein as being provided, related to the Grand Prize, including but not limited to lodging, transportation costs, meals, taxes (including income taxes) and gratuities and other expenses incurred by accepting the Grand Prize] are the sole responsibility of the Winner. Limit one (1) prize per person, family or household.
The Prize is non-transferable, with no cash redemptions or substitutions except at USA Bid Committee's sole discretion. USA Bid Committee reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. All prize details are at USA Bid Committee's sole discretion.
Contest Administration
USA Bid Committee will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by USA Bid Committee regarding the Contest shall be final and binding in all respects.
General Conditions
By participating in the Contest, each Participant in the Contest accepts and agrees to be bound by these Official Rules, including all eligibility requirements, the gousabid.com Privacy Policy and gousabid.com Website Terms of Use.
The potential Winner will be notified by e-mail and/or telephone by USA Bid Committee. In the event that the potential Winner does not respond to any such notification within three (3) days of date of issuance, a disqualification will result and, at USA Bid Committee's discretion, a runner-up may be notified. The potential Winner must execute and return an Affidavit of Eligibility and Release of Liability, and, unless prohibited by law, Publicity Release, which must be executed and returned within ten (10) days of date of receipt. A disqualification will result and a runner-up may be notified from among all remaining eligible entries if the USA Bid Committee's Affidavit of Eligibility and Release of Liability are not properly returned within the specified period of time. Refusal or return of such documents as non-deliverable or noncompliance with these Official Rules will also result in disqualification and, at USA Bid Committee's discretion, may cause the runner-up to be notified.
All applicable federal, state, provincial and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York. Any court of competent jurisdiction sitting within the State of New York, New York County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these
Official Rules
The USA Bid Committee, the other USA Bid Committee Entities and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, "Released Parties") shall not be responsible for stolen, late, misdirected, lost, damaged, garbled, delayed, incomplete or inaccurate entries or photos/ photo captions. Entries generated by a script, macro or other automated means will be disqualified.
USA Bid Committee reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
Released Parties make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, Participant agrees to hold harmless and fully release Released Parties from any and all liability for any injuries, losses, death, or damages of any kind caused by participation in the Contest, any prize or resulting from the acceptance, possession, quality, use or misuse of any prize, or any portion of any prize or travel related to the receipt or use of any prize or USA Bid Committee's, the USA Bid Committee Entities' or their respective designees' use of any entry .
The Contest is a skill contest designed to increase consumer awareness of and interest in the USA Bid Committee and the USA Bid, the Official Site of the USA Bid Committee; gousabid,.com. This Contest may not be used for any form of gambling. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, USA Bid Committee, the other USA Bid Committee Entities and reserves the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In such event USA Bid Committee further reserves the right to judge all non-suspect, eligible entries received prior such event and award the Grand Prize using the judging process described above as of the termination date.
Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to Participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest; or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prize or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest.
Persons who tamper with or abuse any aspect of the Contest or website or who are in violation of these Official Rules, as solely determined by USA Bid Committee, will be disqualified and all associated entries will be void. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, USA BID COMMITTEE, THE OTHER USA BID COMMITTEE ENTITIES AND EACH OF THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
All entries must include a valid e-mail address for the Participant. In case of multiple entries received from the same person or email address, only the first entry received from such person or email address will be considered. In the event of a dispute as to the identity or eligibility of a Winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of the entry provided he/she is eligible according to these Official Rules. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
In the event that the Contest is challenged by any legal or regulatory authority, USA Bid Committee reserves the right to discontinue or modify the Contest, or to disqualify Participants residing in the affected geographic areas. In such event, Released Parties shall have no liability to any Participants who are disqualified due to such an action.
